Last night was probably a late one, so it will be a slow start for the morning.
Yeah for me it was late, did not get home from Jury Duty till after 10 and was dead dog tired and too wired up to go to sleep for a while.  Guilty verdict inAbout 1 hour yesterday morning and then got a mistrial on the sentencing.  Basically had 1 juror that went crazy and did not want the guy to go to prison wanted him to have rehab.  All he did was stab his girlfriend with an 8" chef knife in the arm, then in the back all the way through her kidney breaking the knife handle off and then getting a pair of kitchen scissors and stabbing her with those in the neck behind the ear severing the primary facial control nerve, then slammed he face into the tile floor and wall a few times.  And to,top it off he was a 3rd strike felon and the sentencing guidelines were a minimum of 25 years to life.

So what happens next?  Another group has to do the sentencing?  Judge?
In Texas defendant has the right to choose Judge or Jury sentencing after the verdict.  There will be another trial with a new jury but that will take a minimum of 4-6 months to start.  Good side is the guy is in prison now for parole violations and has 5 years left on that sentence so he is not getting on the street before the next trial.  Down side is the evidence is sketchy and if he had a good lawyer rather than a court appointed one he would likely have gotten off.  So who knows what the next jury might do!  Austin cops blew the whole damn thing and states prosecuter was incompetent so a top tier criminal lawyer would have eaten them.  What sunk the guy was he wanted to testify in his own defense.
