Interesting because other sources have said he refused the breathalyzer test.

Well, this is the actual police report, so that continues to show what you can learn from "unnamed sources".

Doesn't really matter because DUI is under the Influence and it can be drugs or alcohol, whether or not the drugs are legal or prescribed does not matter.

But not if he was not driving....I think that's the D part.....

Surprised OneDayDave didn't get this posted right away considering what a "The Bachelorette" fan he is, and with Dancing with the stars done for anotther weekend.

Michael Nance, who was a former contestant on "The Bachelorette," is dead at 31, E! reports.

Nance was found dead in the early morning of Memorial Day -- Monday, May 29 -- and not much else is known about his death.

Police officers in Austin, Texas, pronounced Nance dead at 2:54 a.m. after responding to reports of an unresponsive male.

Laws are pretty universal on that one -  you are driving if behind the wheel, clear and simple as that. 

Boy said Drunk Driving is a lot easier to get out of than drug driving and since he was mouthing off that his head was all fuct up on a drug mixtue then probably going to be pretty tough to get anything better than a moderate plea bargain but you never know what might happen with famous people.
